Weitz & Luxenberg Obtains Historic $190 Million Verdict in Mesothelioma Case
A New York Supreme Court Jury returned a verdict late Tuesday, rendering a verdict worth a total of $190 million. The verdict concludes a lawsuit brought by five Weitz & Luxenberg clients exposed to asbestos while working in New York as plumbers, boilermakers, and construction workers. It is believed that the $190 million verdict is the largest consolidated asbestos verdict in NYC history. Read the full release here.
Robin Greenwald Testifies in U.S. Senate Committee Hearing on Toxic Chemical Threats 
Weitz & Luxenberg's Robin Greenwald testified July 31st in a Senate committee hearing concerning changing a law that protects people against the dangers of toxic chemicals. The need for stronger state laws, access to the courts by private citizens, and other public health protections was the subject of Greenwald's testimony, which was requested by the Environment and Public Works Committee for their hearing about reforming the Toxic Substances Control Act. Bills designed to regulate exposure to toxic chemicals are an important protection for citizens, according to Greenwald's testimony, but are dependent on state-level regulation and enforcement. Greenwald, who headed Weitz & Luxenberg's role in the BP Oil Spill litigation, said reform was sorely needed, but that the proposed Senate bill was not the answer. Read the full press release here.
FDA Launches Probe into Hip Replacement Devices
The FDA has announced plans to commission a study of the corrosion that occurs in certain models of metal hip implants, saying more data is needed to safeguard patients. The new study will examine hundreds of types of prosthetic devices, many of which are the subject of litigations Weitz & Luxenberg is helping to lead. Read the full story here.
FDA Issues Recall of Mislabeled Tracheostomy Tubes
The Food and Drug Administration has issued a Class I recall of a surgical product that may have injured or killed neonatal infants. Certain Bryan Medical Tracoe Mini 3.0mm Tracheostomy Tubes – small tubes used in surgical procedures to help clear airways for newborn patients – may have been distributed with incorrect packaging, prompting the FDA to issue its most serious classification of recall. A larger size of tracheostomy tubes intended for use in older children, according to the FDA, have in some cases been labeled as being suitable for use in neonatal patients, potentially leading to injury or death for some newborn babies.

In Wake of Massive Train Derailment, Weitz & Luxenberg Stands Ready to Help
A 72-car freight train derailed and exploded in the downtown area of a small Quebec town on July 6, destroying 30 buildings and killing at least 35. The train, which was hauling crude oil, jumped its tracks at more than 50 miles per hour, causing at least five cars to burst into flames and sending tens of thousands of gallons of crude oil into Lac Mégantic, a lake on the Canada-Maine border. Weitz & Luxenberg is currently investigating the incident, and asks residents or other affected parties to contact the firm. A Weitz & Luxenberg client who for eight years worked removing asbestos from New York-area buildings has won $35 million from industrial products manufacturer Crane Co. The Queens man developed mesothelioma after being repeatedly exposed on the job to asbestos, bringing suit against Crane Co. American Bar Assn. appoints Ellen Relkin as co-chair of important subcomittee
Ellen Relkin, Esq., of Weitz & Luxenberg PC, has been appointed co-chair of the American Bar Assn.'s Pharmaceutical and Medical Device Subcommittee for the 2013-14 term. The important subcommittee is part of the Mass Torts Committee within the ABA's Section of Litigation.
